OZARK MOTOR LINES INC. BIOMETRICS POLICY
The Ozark Motor Lines, Inc. (“Ozark”) Onboard Camera Policy provides that the primary use of
onboard cameras is to assist in the protection and safety of persons and property, protection from
or detection of criminal offenses, defense or initiation of legal claims, and driver training.
The Onboard Camera Policy mandating the use of dual dash cam equipment for Ozark’s drivers is a
motor carrier safety improvement designed to: (1) ensure compliance with traffic safety and motor
carrier safety laws; (2) improve the safety of equipment operated under Ozark’s operating
authority; (3) provide training designed to improve the safety of Ozark’s drivers; and, (4) improve
the safety of the motoring public and third party users of public roadways.
All Ozark drivers, employees and owner operators shall be required to utilize power units
equipped with forward and driver facing video cameras as a condition of driving for Ozark.
Ozark’s experience has shown that the dual dash cam implementation has improved safety. The
dual camera equipment captures audio and video when in operation. The forward-facing camera
is operational whenever the vehicle is on and provides the driver’s view of the activity ahead. The
forward-facing camera has proven in the vast majority of cases, that its drivers were not the cause
of accidents. The driver-facing camera captures the driver’s image and activity while the vehicle
is in motion. It also has been crucial in determining the causes of accidents. In addition, it
proactively promotes safe driver behavior prospectively and is a useful tool for assessing driver
behavior retrospectively.
The cameras cannot be used in real time to track the driver’s movements. Cameras are set up in a
way that ensures that there is minimal intrusion of privacy, and any limited intrusion is fully
justified. Recorded images and information will be subject to appropriate security measures to
safeguard against unauthorized access and use. No images and information will be stored except
where a relevant incident has occurred. Access to retained images and information will be
restricted to appropriate Ozark personnel, its insurers, agents, attorneys and others based upon a
need-to-know standard for review. Under appropriate circumstances, video footage may be
provided to police, highway patrol, or other appropriate authorities. Video footage may also be
provided to Ozark’s legal representatives with the intention of and for the purpose of gathering
facts, and if necessary, for providing discovery or evidence as part of legal proceedings. Where an
incident is captured that reveals inappropriate conduct, Ozark reserves the right to proceed in the
interest of the business. This may include, but is not limited to, the use of video footage in:
personnel or disciplinary proceedings; defense or investigation of a legal claim; and, driver
training. When relevant to do so, camera footage may be retained and used for future health and
safety training of drivers.
It is a violation company policy for any employee and/or contractor to disable, destroy, tamper
with, or cover the camera by any means that would hamper the ability to capture video data.
Any person found to be in violation of this policy shall be subject to discipline, up to and
including, termination of employment
OZARK MOTOR LINES, INC. BIOMETRIC DATA
SECURITY POLICY CONCERNING DASHCAM VIDEO
A. Purpose
This Biometric Data Security Policy defines the Ozark Motor Lines, Inc. (“Ozark”) policy and procedures for
collection, use, safeguarding, storage, retention, and destruction of biometric data collected by Ozark’s
third-party dashcam vendor(s), including Lytx.
B. Definition of Biometric Data
Biometric data means personal information stored by Ozark and/or Ozark’s vendor(s) about an
individuals’ physical characteristics that can be used to identify that person. Specifically, for the dashcam
video systems, the biometric data to be stored under this Policy will be video recordings of the driver’s
face that are captured by the camera system each and every time that the driver drives, operates or is
otherwise inside the tractor in an “on-duty” status.
C. Policy
Ozark’s policy is for it and its vendor(s) to protect and store biometric data in accordance with the
applicable standards and laws. An individual’s biometric data will not be collected or otherwise obtained
by Ozark or its vendor(s) without prior written consent of the individual. Ozark will inform the employee
of the reason his or her biometric information is being collected by the vendor(s) and the length of time
the data will be stored. A consent form is attached to this Policy.
Ozark will not sell, lease, trade, or otherwise profit from an individual’s biometric data. Biometric data will
not be disclosed by Ozark or its vendor(s) to third parties unless: (i) consent is obtained; (ii) required by
law; or (iii) required by valid discovery request, subpoena or warrant. Ozark retains the right to use the
dashcam video data as part of its assessment of driver performance and driver safety and in its
investigation, negotiation, and/or litigation concerning an accident involving the driver and/or involving
any equipment owned by Ozark, under contract with Ozark, or utilized under Ozark’s operating authority.
The biometric data referenced herein will be securely stored by Ozark and/or Lytx during the term of an
employee’s employment with Ozark. The biometric data will be stored using a reasonable standard of care
and in a manner that is the same or exceeds the standards used to protect other confidential and sensitive
employee information held by Ozark.
Ozark will have Lytx securely and permanently destroy an employee’s biometric data when the first of
the following occurs:
– The initial purpose for collecting or obtaining such biometric data has been satisfied, such as the
termination of the employee’s employment with Ozark, or the employee moves to a role within
Ozark for which biometric data is not used; or
– Within one (1) year of the employee’s last interaction with Ozark.
